Automated photo enforcement and statutory authority in New Jersey
Under N.J.S.A. 39:4-81, all motorists approaching a circular red signal or red arrow must bring their vehicle to a complete stop before entering the crosswalk or intersection. Red light camera pilot program expired in 2014 and was not renewed; cameras prohibited.
Where automated photo enforcement operates, notice of infraction is mailed to the registered vehicle owner based on automated camera images. In contrast to officer-initiated stops where the driver is directly identified and handed a summons, photo citations in New Jersey focus on registered ownership. Most municipal programs require local courts or administrative review tribunals to review photographic evidence prior to issuing a citation.
