The South Carolina hands-free and distracted driving statute
Under S.C. Code § 56-5-3890, drivers on public roads may not hold, support, or manually operate electronic communication devices while operating a motor vehicle on active roadways. Texting ban with primary enforcement; civil infraction without points.
Law enforcement officers throughout South Carolina are authorized to issue citations whenever visual observation confirms prohibited device interaction. Permissible mobile use is generally restricted to manufacturer-installed integrated dashboard interfaces, single-tap voice activation, or true hands-free speakerphone arrangements mounted securely to the vehicle console.
