The Wisconsin hands-free and distracted driving statute
Under Wis. Stat. § 346.89, drivers on public roads may not hold, support, or manually operate electronic communication devices while operating a motor vehicle on active roadways. Texting ban primary; handheld ban applies in road construction and school zones with 4 points.
Law enforcement officers throughout Wisconsin are authorized to issue citations whenever visual observation confirms prohibited device interaction. Permissible mobile use is generally restricted to manufacturer-installed integrated dashboard interfaces, single-tap voice activation, or true hands-free speakerphone arrangements mounted securely to the vehicle console.
