The New York hands-free and distracted driving statute
Under NY VTL § 1225-c, 1225-d, drivers on public roads may not hold, support, or manually operate electronic communication devices while operating a motor vehicle on active roadways. Strict primary hands-free ban; 5 points assessed on DMV driving record.
Law enforcement officers throughout New York are authorized to issue citations whenever visual observation confirms prohibited device interaction. Permissible mobile use is generally restricted to manufacturer-installed integrated dashboard interfaces, single-tap voice activation, or true hands-free speakerphone arrangements mounted securely to the vehicle console.
