The Pennsylvania hands-free and distracted driving statute
Under 75 Pa.C.S. § 3316, drivers on public roads may not hold, support, or manually operate electronic communication devices while operating a motor vehicle on active roadways. Primary enforcement texting ban; civil fine without points.
Law enforcement officers throughout Pennsylvania are authorized to issue citations whenever visual observation confirms prohibited device interaction. Permissible mobile use is generally restricted to manufacturer-installed integrated dashboard interfaces, single-tap voice activation, or true hands-free speakerphone arrangements mounted securely to the vehicle console.
