The Texas hands-free and distracted driving statute
Under Tex. Transp. Code § 545.4251, drivers on public roads may not hold, support, or manually operate electronic communication devices while operating a motor vehicle on active roadways. Statewide texting ban with primary enforcement; local hands-free ordinances apply.
Law enforcement officers throughout Texas are authorized to issue citations whenever visual observation confirms prohibited device interaction. Permissible mobile use is generally restricted to manufacturer-installed integrated dashboard interfaces, single-tap voice activation, or true hands-free speakerphone arrangements mounted securely to the vehicle console.
